Hi. Evan Nappen, Independent Program Attorney for U.S. LawShield for the State of New Jersey. The hunting season’s coming up and in New Jersey, there are some things you should be very concerned about.
Lawfully Hunting
New Jersey’s entire gun law structure is based upon exemptions, and one of the exemptions for possession of your firearm is you’re lawfully engaged in hunting. If you’re in violation of any hunting or fishing laws, then your exemption for possession of your firearm becomes invalid. This can turn into a felony level gun possession charge. So, you always need to be very carefully following New Jersey’s fish and game laws, particularly when dealing with a firearm.
Loaning a Firearm
So, can you loan a firearm to a friend while hunting? That’s one of the rare areas in New Jersey called “temporary transfer” where there’s a lot of requirements. What you can’t do is give your gun to your buddy and say, “Hey, have a good time hunting.” You have to be with them the whole time.
Hollow Nose Slugs
The other thing I want to mention, and it comes up a lot is: “Can I use a hollow nose slug to hunt deer?” Well, assuming you’re otherwise legal for the hunting of deer, it’s deer season, and you’re allowed to use slugs in that location, the answer is yes. Keep in mind that while on a hunt, you may have encounters with conservation officers. Always be respectful and be very mindful that you are always within those exceptions because they will most likely be checking your gun. Make sure your gun is legal, that your ammo’s legal, you have the correct number of rounds, and that the correct color hunter orange is being worn.
