Know Your Ammo – Florida

There are so many varieties of ammo on the market today, but not every type is perceived the same in the eyes of the law. Watch Independent Program Attorney James Phillips explain how the type of ammo you use could affect you.  

James Phillips: Florida does place some restrictions on the kind of ammunition used. A detailed list of the prohibited ammunition can be found in Florida statute 790.31, which includes armored piercing bullets used in handguns, exploding bullets, dragon breath shotgun shells, bolo shells and flechette shells. Anyone that knowingly has these prohibited ammunitions loaded in their firearm commits a 3rd-degree felony punishable up to five years in prison. So you can carry any other type of ammunition not listed in 790.31

At U.S. LawShield, we are often asked by members, if I was forced to shoot an attacker in self-defense, does it matter what caliber the gun was or the type of bullets I used? There is no restriction on the size of caliber you use and the only restriction on the bullets used are the bullets we just discussed.

However, it is important to know a prosecutor in a criminal case or the plaintiff in a civil case may try to use the caliber or the type of bullets used to show you had the intent to kill or cause maximum damage to another.
