Day or night, does it matter in the State of Oklahoma? In Oklahoma, the law of self-defense does not change depending on the time of day. The law can be found at 21 Oklahoma statute, Section 733 (in particular, sub-section 2). In summary, it states, “A person may use deadly force in defending themselves from an attack which reasonably threatens grievous bodily harm or death; or when the person uses deadly force to interrupt or stop the commission of a forcible felony.”
It does not matter in the State of Oklahoma whether or not it is nighttime or daytime. Those items are items for argument among defense counsel and the prosecutor.
