Texas State Representative Rafael Anchia (D-San Antonio) is at it again. On November 29, 2016, Anchia pre-filed HB 465 to be considered when the 85th Legislative Session begins on January 10, 2017.
We have previously reported on Anchia’s several other proposed pieces of legislation attacking gun rights, and now he seeks to further restrict where law-abiding gun owners can legally carry their handgun for protection.
Under his proposed measure, nearly every part of a school would be off-limits to LTCs, not merely the “premises.” Also, HB 465 designates numerous other areas as “an educational institution,” including libraries, children’s nurseries, day-care facilities, after school programs operated by public or private schools, post-secondary institutions (both public and private), and vocational and technical schools.
Furthermore, it would expand the definition of amusement parks that would be permitted to ban firearms to include any park of at least ten acres with a controlled access offering amusement rides to the public, regardless of the size of the county in which the park is located. The ban would also include parking lots and garages as well. And no longer would the prohibition be limited to parks that were open for at least 120 days per year. Currently, only parks that compose at least 75 acres located in a county of at least one million persons and are open at least 120 days can legally ban handguns.
