So say you neutralize that active shooter with your firearm. You shoot through him, that bullet overpenetrates and hits an innocent bystander behind him.

Could you be civilly liable for the damages caused to that third party?

And the answer is absolutely Yes!

They may file a lawsuit in order to gain medical expenses, lost wages, loss of consortium. There’s a whole litany of things that they could bring suit in order to gain damages.

Now what you need to remember is that here in Texas, if you were legally justified on the criminal side, then that lawsuit hopefully will never make it to trial. But if it does, then we’ve got a great argument that since you were legally justified, that these damages and that lawsuit should just go away.
